We ordered the "Helper" sink machine from Midas Stone Machinery on April 9, 2008.  We paid a 30% deposit & was told that the machine would be delivered in app. 8 weeks....after 8 weeks we called & was told that they were waiting on parts from Italy.  After 12 weeks we were told the same thing, 2 weeks ago the same thing at which time we said if the machine was not in our shop by July 11, 2008, we wanted to cancel the order & wanted our deposit refunded, the sales manager said "fair enough" last week, we tried to contact them by phone, fax & email with no response except on Friday to be told that she (sales manager) was out of the office & that the machine would be ready by this week..we told her that we had faxed, emailed & mailed a cancellation & wanted our deposit returned.  She refuses to give our deposit back & said that now the machine is ready, we are so frustrated at the whole thing & just want out deposit returned.  She stated that the contract states that the machine is special ordered & cannot be returned, how can we return something we don't have, it does not say anything about cancelling the order.  We paid $4100.00 deposit & realize now that we should have ordered it through Braxton Bragg since they have the exclusive on this item.  Any suggestions?
